Rental Policy

Modeste Dress Rentals, LLC (“Modeste Dress Rentals” or “our”) provides a service that allows you to rent apparel from numerous brands. The following Terms of Service (also, “Agreement”) between you (“you” or “your” or “Customer” or “Customers”) and Modeste Dress Rentals describe the agreement on which you may access and utilize our services located at www.modestedressrentals.com (the “Website”). Modeste Dress Rentals reserves the right to change these terms and conditions from time to time at its sole discretion.

By accessing the Website and/or placing an order with Modeste Dress Rentals, the Customer agrees to all terms set forth in this Agreement and agrees to cover the cost of the apparel rental(s) and any damages/loss/theft and/or late charges incurred on the rental. The Customer consents to Modeste Dress Rentals charging the Customer’s original form of payment to cover these costs and any additional fees, including but not limited to damages/loss/theft and/or late charges incurred on the rental, owed to Modeste Dress Rentals, as mentioned within this Agreement. 

This policy includes all the terms and conditions that govern renting apparel from Modeste Dress Rentals. Modeste Dress Rentals’ apparels may only be rented to individuals of 18 years of age and older, who may rent with a credit card or other accepted methods of payment and are located within 50 miles of Houston’s downtown. Customer agrees that all apparel rented from Modeste Dress Rentals is the property of Modeste Dress Rentals and must be returned by the agreed rental deadline in order to not incur any additional charges.

I. Rental Fee Policy

The apparel rental fee for Modeste Dress Rentals is the daily rate of the apparel multiplied by days of the Customer’s specified booking period. The minimum booking period for any apparel is 3 days (72 hours) and the maximum booking period for any apparel is 7 days (168 hours). Upon submitting your order through our website, you authorize Modeste Dress Rentals to immediately charge your original form of payment 30% of the apparel rental fee, known as the “Pay Now” amount, and any taxes and fees. The “Pay Now” amount is a non-refundable charge that is required to book the desired apparel for your selected booking period. 

An invoice for the “Pay Later” amount (which is the remaining 70% of the apparel rental fee), along with the security deposit and any taxes and fees, will be sent to the Customer via email in a separate invoice with a payment due date of 2 days prior to the start date of the booking period. Failure to make this payment will cancel your entire order.

All sales listed on Modeste Dress Rentals are final.

II. Security Deposit Policy

All Customers will be charged a one-time, conditionally refundable security deposit of either $75.00 USD, $100.00 USD, or $150.00 USD (depending on the value of the apparel) before being shipped their rental apparel.

When renting our apparel, it is expected that they will be treated with the utmost care and respect as if they were your own. If an item is damaged beyond repair you will be required to pay 100% full RRP (Recommended Retail Price) of the item, inclusive of the full security deposit amount previously charged. 

Modeste Dress Rentals closely inspects and photographs each apparel prior to shipping out the apparel and upon receipt of the returned apparel. Within 3 business days after receiving the returned apparel, Modeste Dress Rentals will provide a determination to the User regarding the refund of their security deposit, depending on the conditions below.

If an apparel is returned in the original condition it was rented out to the Customer, then the full amount of previously charged security deposit will be refunded back to the Customer. Modeste Dress Rentals will process the refund to the original payment method within 10 business day(s).

If an apparel is not returned in the original condition it was rented out to the Customer, then the Customer is responsible for any damages that occur while the apparel is in your possession (including but not limited to greater than 5 missing sequins/beading, stains, rips, holes, pulls or tears), and the Customer will be required to pay the corresponding Damage Fees, by deducting all applicable Damage Fees (specified below) from the security deposit.

If the total Damage Fees exceed the security deposit (due to multiple holes, rips, stains, etc), the Customer authorizes Modeste Dress Rentals to charge the Customer’s original form of payment for any amount exceeding the security deposit. 

Modeste Dress Rentals will provide before and after photos of “damaged” areas of the apparel to the Customer and provide an itemized receipt specifying all Damage Fees, security deposits, and any taxes and fees.

Damage Fees:

  • More than 5 total missing sequins/beads: $10 USD
  • Small (surface area smaller than 6 inches) stain removal: $15 USD
  • Large (surface area larger than 6 inches) stain removal: $25 USD
  • Rips/tears/pulls less than 6 inches in length: $30 USD
  • Rips/tears/pulls greater than 6 inches in length: $40 USD
  • Hole (surface area smaller than 6 inches) repair: $50 USD
  • Hole (surface area larger than 6 inches) repair: $75 USD

III. Return Policy

If your apparel will be returned via shipping

The Customer’s Return Date for their apparel is the day after the end date of the Customer’s booking period. You agree to return your rental apparel back to Modeste Dress Rentals by shipping the rented apparel at any post office on your Return Date, at the latest. The return shipment must be postmarked before 12pm CT on your Return Date. If your ship back date falls on a Sunday or federal public holiday, you may return your rental apparel back to us the following business day (Monday to Friday) by 12pm CT. 

Modeste Dress Rentals will provide you with a return shipping label and instructions on how to return the rental item. THE CUSTOMER MUST RETURN ALL APPAREL WITHIN THE ORIGINAL PACKAGING THAT THE APPAREL WAS ORIGINALLY SHIPPED IN. ALL APPAREL MUST BE IN THE ORIGINAL PLASTIC GARMENT BAGS BEFORE BEING PACKED INTO THE ORIGINAL PACKAGING.

If the rental apparel is not postmarked by the 7th day, the Customer authorizes Modeste Dress Rentals to charge an additional late return fee of $50.00 USD every day for up to 7 days including any taxes and fees. If 7 days have passed and a garment is never returned back to Modeste Dress Rentals, then the Customer forfeits any security deposit paid to Modeste Dress Rentals, and further authorizes Modeste Dress Rentals to charge 200% RRP (Recommended Retail Price), minus any applicable security deposit, of the apparel to the original form of payment on file including any taxes and fees. 

If your apparel will be returned via local drop-off:

Confirm the drop-off information (location, date, and time) with Modeste Dress Rentals. Arrive at the drop-off location, at the agreed upon date and time, with your rental apparel to complete the return. Modeste Dress Rentals will send the Customer an email afterwards to document the exchange. 

IV. Apparel Care Policy

Modeste Dress Rentals utilizes luxury garments that are delicate in nature and expensive to replace/repair. The following guidelines are applicable to all of our apparel:

  • Deodorant must be used with all rental wear 
  • Underwear must be used with all rental wear
  • Body makeup/spray tanning may not be near or when the rental wear is used
  • The rental wear must be lifted off the ground when walking
  • Extra care it to be exercised with ingesting food or beverages to avoid staining the apparel
  • Rental wear may not be worn near mud, water, wet sand, sharp objects or trees, or any other hazard that may damage the apparel in any way

It is understandable that during transit, apparel can become wrinkled. If a Customer receives apparel in this state, please refer to the apparel care instructions included within your package.

When returning your rental apparel, do not spot clean or dry clean. Modeste Dress Rentals will handle all the cleaning for you.

V. Reservation Policy

Once a Customer browses our inventory of luxury wear and checks availability of desired item using our live calendar, reservation of the apparel must be made on our Website.

Reservations can be made no earlier than 3 non-holiday business days from the current date by 12PM CT to guarantee a smooth and successful delivery. We recommend not selecting the start date of your booking period to coincide with your event date in order to ensure some margin for any unforeseen delays that are out of our control.

Example 1: Event is on Friday evening. The Customer must submit their rental order by Tuesday 12pm CT.

Example 2: Event is on Saturday/Sunday/Monday evening. The Customer must submit their rental order by Wednesday 12pm CT. 

In the rare case of unforeseen circumstances such as, but not limited to, the reserved apparel being damaged beyond repair from a prior rental or unavailable due to the apparel not being returned back to Modeste Dress Rentals in time for proper cleaning, then we will contact you via email, and/or other available contact methods, and provide you with the opportunity to choose apparel available at that point in time to substitute for your initial apparel choice free of additional rental charges and shipping costs to make it right for the Customer. 

Customer agrees and understands that Modeste Dress Rentals will not be held liable for health-related complaints, such as allergic reactions to fabrics and cleaning methods associated with rental items. Modeste Dress Rentals’ apparels can range between brand new, like new, or used condition.. 

Modeste Dress Rentals does not take responsibility for orders where the Customer provides an incorrect shipping address. No refund or credit of any kind will be issued, should this occur, and the Customer will be liable for any late/replacement apparel fees.

 

Refund Policy 

We do not offer refunds for incorrect sizing, change of mind (including styling issues), postage delays, promotional sales or cancellations of bookings. 

If you receive your rented item not as described or faulty, please contact us via email within 12 hours of delivery. If the item is faulty, you must provide images via email so that we can evaluate the discrepancy and correct the order for you.

If your rental item is never delivered to your address and is lost in transit, you will receive a full refund for your order.

Should any of the above rare instances occur, we will do our best to make things right with you and resolve the issue.

Modeste Dress Rentals is not liable for any delayed deliveries due to carrier service; we provide tracking information and the rest falls into carrier responsibility.

Cancellation Policy

In the event a Customer cancels their rental apparel order, the “Pay Now” amount is non-refundable.

Try-On Service Policy

As this is an online business, we do understand that sizing/styling issues may occur for Customers that elect to rent an apparel without trying on the apparel beforehand. Full descriptions and approximate, not exact, measurements of the apparel are included on our website. It is your responsibility to ensure you have measured yourself and read through the apparel description prior to placing your rental order. All rental sales are final and no refunds will be issued for this occurrence. 

We do provide free virtual consultation appointments where Customers can request to see the product up close on video, and ask all necessary sizing questions to ensure that the desired apparel is an appropriate choice for each Customer. If a virtual consultation appointment is not possible for the Customer, there is an option to physically try on the apparel at our business location located in South Houston. Please contact us via our website, instagram, or email to book a try-on appointment with Modeste Dress Rentals.

If you experience a fit or style issue once you receive your rental item, please contact us within 12 hours of receiving your item to arrange a style exchange. See below “exchanges/rescheduling policy” for additional information.

Exchanges/Rescheduling Policy

If a Customer would like to request an apparel or booking period date change, the original order will be cancelled and the “Pay Now” amount paid by the Customer will not be refunded. Please reach out to Modeste Dress Rentals with a description of your situation and we will try our best to help you out as much as we can.  

 

Copyright and Privacy Policy 

By accessing and using the Modeste Dress Rentals Website, you are accepting and consenting to the practices in this Terms of Service. Modeste Dress Rentals reserves the right to change this Agreement at any time at Modeste Dress Rentals’ sole discretion.

Copyright Policy

This website is owned and operated by Modeste Dress Rentals, LLC. The site, its contents (which may include but is not limited to the design of the website, images, photographs, text, and graphics), and any associated material on the website are copyrighted to Modeste Dress Rentals.

You are permitted to view, copy, print, and distribute the information within this website,  subject to the following:

• Your use of Modeste Dress Rentals’ materials is for informational, personal and non-commercial  purposes only

• You will not modify, copy, or distribute the information or graphics

• You agree that Modeste Dress Rentals may revoke this permission at any time and you will immediately stop your activities related to this permission upon notice from Modeste Dress Rentals 

The permission above does not include the permission to copy the design elements, look and feel, or layout of this website.

At Modeste Dress Rentals, we respect the privacy of our online visitors. Unless otherwise authorized by yourself, we will not use your personal information except in accordance with our Privacy Policy below.

The purpose of this Privacy Policy is to inform you about what types of personal information we collect, and how we store and use the information that you provide us with.

Collection of Information

Information is collected from you primarily to bring you a more personalized shopping experience on our services. By renting items from Modeste Dress Rentals, you are consenting to the collection of your personal information.

When you place an order with us, we are required to obtain your personal information including, but not limited to, your first and last name, email address, phone numbers, residential address, shipping address, and payment method details. This information is collected in order to process and fulfill your order request.

We collect and use email addresses and mobile numbers when you order from the site so that we can send you any necessary email and text messages related to your order – such as an order confirmation notice and a reminder of a late item.

We record data regarding Customer activities on our website to analyze data about web page traffic. This assists us to improve our website to tailor it to our Customers’ needs.

Dispute Resolution

In the case of any dispute that arises from a rental order, the laws of the State of Texas shall apply. Furthermore, any dispute shall be resolved in the State or Federal Courts located within Galveston County, Texas. 

Entire Agreement and Severability

This Agreement regulates Modeste Dress Rentals association with the Customer concerning any services received by the Customer. You confirm that, by accepting this Agreement, you have not depended on any portrayal other than what is clearly stated in this Agreement, and you agree that you have no recourse for any such portrayal not contained in this Agreement. Each clause of this Agreement shall be interpreted as individually effective and enduring, even if one or another of those provisions is deemed inapplicable or unenforceable under the circumstances.
